Criminal Defense for Foreign Nationals in Türkiye
Being investigated, detained, or charged with a crime in a foreign country is one of the most stressful situations a person can face. The Turkish Penal Code and criminal procedure system operate differently from most Western legal systems, and the consequences of a conviction — including imprisonment, deportation, and travel bans — can be severe.
At Yilmaz Attorneys, we provide criminal defense representation to foreign nationals in Türkiye. Whether you have been detained by police, are under investigation, or have been formally charged, we act quickly to protect your rights and work toward the best possible outcome.
When You Are Detained or Arrested
If you are detained by Turkish police, you have the right to an attorney from the very first moment. Early legal intervention is critical — statements made during police questioning can significantly impact the outcome of your case. We provide:
Immediate response — We attend police stations and prosecutor offices to be present during questioning and ensure your rights are protected.
Communication support — We explain the process in English and ensure you understand what is happening, what your rights are, and what to expect next.
Bail and release applications — We apply for release at the earliest opportunity, arguing against unnecessary pre-trial detention.
Consular coordination — We help coordinate communication with your country's embassy or consulate if needed.
Types of Criminal Cases We Handle
Our criminal defense practice covers charges under the Turkish Penal Code (TCK) and related legislation, including:
Assault and bodily harm — Charges ranging from minor altercations to serious injury cases.
Fraud and financial crimes — Including check fraud, commercial fraud, and tax-related offenses.
Drug offenses — Possession, use, and trafficking charges under Turkish narcotics law.
Theft and property crimes — Burglary, robbery, and damage to property.
Traffic offenses — Including accidents resulting in injury or death, driving under the influence, and hit-and-run.
Cybercrime — Offenses involving digital systems, unauthorized access, and online fraud.
Domestic violence and protection orders — Defense in cases involving protective orders under Law No. 6284.
Deportation-related charges — Criminal proceedings connected to immigration violations or deportation orders.
The Criminal Process in Türkiye
Understanding the Turkish criminal justice process helps manage expectations:
Investigation phase — Led by the public prosecutor, who gathers evidence and decides whether to file an indictment. Suspects may be questioned, and search or seizure orders may be issued.
Indictment — If the prosecutor finds sufficient evidence, a formal indictment is filed with the criminal court.
Trial — Turkish criminal trials are conducted by judges (not juries). The court hears evidence, examines witnesses, and reviews expert reports.
Judgment and sentencing — If convicted, sentencing considers the severity of the offense, mitigating factors, and the defendant's personal circumstances.
Appeals — Convictions can be appealed to the Regional Court of Appeal (istinaf) and, in serious cases, to the Court of Cassation (temyiz).
Travel Bans and Judicial Control
During criminal investigations, Turkish courts may impose travel bans (yurt dışına çıkış yasağı) or other judicial control measures that prevent you from leaving the country. We file applications to lift travel bans and argue for the least restrictive conditions possible while your case proceeds.
